2) The Service
Ludica helps coffee enthusiasts document coffee experiences by capturing photos, recording tasting notes and shop details, tracking coffee habits with frequency stats, and building an archive of coffee moments.
We may modify, update, or discontinue parts of the Service at any time.
3) Accounts
3.1 Account information
You may be required to create an account and provide information such as your name, username, and email address. You agree to provide accurate information and keep it up to date.
3.2 Account security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
3.3 Account termination
We may suspend or terminate your access if you violate these Terms or if we reasonably believe your use poses a security risk, violates the law, or harms the Service or other users.
4) Your Content
- Ownership: you retain ownership of photos, notes, and other content you create or upload ("User Content").
- License: you grant Ludica a limited, worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display User Content solely to operate, provide, and improve the Service, and as described in our Privacy Policy.
- Responsibility: you are responsible for your User Content and for ensuring you have all necessary rights to submit it.
- Feedback: if you provide suggestions or feedback, we may use it without restriction or compensation.
5) Acceptable Use
You agree not to:
- Use the Service for illegal, harmful, or fraudulent purposes.
- Attempt unauthorized access to the Service or related systems.
- Interfere with or disrupt the Service, including introducing malware.
- Reverse engineer or attempt to extract source code except where permitted by law.
- Harass, threaten, or violate the rights of others.
6) Optional AI-Assisted Features (If Enabled)
Some versions of the Service may offer optional AI-assisted features (for example, generating structured notes or summaries from user-provided text or images). If you choose to use such features:
- Outputs may be inaccurate or incomplete and are provided for informational purposes.
- You remain responsible for reviewing and deciding how to use any output.
- Your choice to submit content for AI processing is optional and user-controlled.
7) Intellectual Property
The Service (excluding User Content), including software, design, trademarks, and content provided by Ludica, is owned by Ludica or its licensors and is protected by law. You may not copy, modify, distribute, or create derivative works except as allowed by these Terms.
8) Third-Party Services
The Service may integrate with or provide access to third-party services or websites. Ludica does not control and is not responsible for third-party services. Your use of them is governed by their terms and policies.
9) Apple App Store Terms
- These Terms are between you and Ludica Team, not Apple.
- Apple is not responsible for the Service, its content, maintenance, or support.
- If the Service fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligations.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
10) Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." To the maximum extent permitted by law, Ludica disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or secure.
11) Limitation of Liability
To the maximum extent permitted by law, Ludica will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill.
To the maximum extent permitted by law, Ludica’s total liability for any claim will not exceed the amount you paid (if any) to use the Service in the 12 months before the event giving rise to the claim.
12) Indemnification
You agree to indemnify and hold harmless Ludica Team from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service or violation of these Terms, including your User Content.
13) Governing Law; Dispute Resolution; Arbitration
These Terms are governed by the laws of Ludica Team’s principal place of business, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by a recognized arbitration institution, and judgment on the award may be entered in any court with jurisdiction.
You and Ludica waive the right to a trial by jury and to participate in a class action, to the extent permitted by law. Nothing prevents either party from seeking injunctive or equitable relief for misuse of intellectual property or unauthorized access.
14) Changes to These Terms
We may update these Terms from time to time. We will post the updated version and update the Effective Date. Continued use after changes become effective means you accept the updated Terms.
